These terms apply to the 108 Moments app and website ("the service"), operated by Dustin Wells ("we," "us"). By using the service, you agree to these terms. If you do not agree, please do not use the service.

What 108 Moments is

108 Moments is a daily practice app. It offers weekly themes, short daily focuses, and optional guided audio, designed to pair with a physical 108-bead necklace. It is a tool for building a daily habit — nothing in it is professional advice.

Not medical or mental-health care

The service, including the optional wellbeing check-in, is for general self-reflection only. It is not therapy, diagnosis, treatment, or medical advice, and it is not a substitute for care from a qualified professional. If you are struggling, please reach out to a doctor or therapist. If you are in crisis in the United States, call or text 988.

Your account

• You must provide a valid email address you control.
• You are responsible for activity that happens under your account.
• You can delete your account at any time from inside the app.

Your license to use the service

We grant you a personal, non-exclusive, non-transferable license to use the service for your own personal, non-commercial use. All content in the service — text, audio, design, and the 108 Moments name and marks — belongs to us or our licensors. You may not copy, redistribute, sell, or create derivative works from it without our written permission.

Acceptable use

You agree not to:

• Reverse engineer, scrape, or bulk-download the service or its content.
• Use the service to break the law or infringe anyone's rights.
• Interfere with or disrupt the service or its infrastructure.

The necklace

The physical 108-bead necklace is sold separately. Purchases of physical products are governed by the terms presented at the time of purchase.

Pricing

The app is currently free. If we introduce paid features in the future, their pricing and terms will be presented before you buy anything.

App store terms

If you downloaded the app from Apple's App Store or Google Play, their standard terms also apply, including Apple's Licensed Application End User License Agreement where required. Apple and Google are not responsible for the service and have no obligation to provide support for it.

Termination

You can stop using the service at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your license to use the service ends; your right to have your data deleted (see our Privacy Policy) survives.

Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee the service will be uninterrupted or error-free, or that any particular result will come from using it.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us for it in the twelve months before the claim (which, for a free app, may be zero).

Governing law

These terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules.

Changes to these terms

We may update these terms from time to time. If we make meaningful changes, we will update the date at the top of this page and, for significant changes, note it in the app. Continuing to use the service after changes take effect means you accept the updated terms.
